Commercial speech is protected by the First Amendment. But answers dealing with the constitution are never short. Although commercial speech is due first amendment protection, because of its commercial nature, the Supreme Court has held that its regulation by government is not subject to the same degree of scrutiny as non-commercial speech. A significant chunk of the year long Constitutional Law class in law school is devoted to an analysis of the varying standards of review that are applicable to various types of speech, including commerical speech.
