    Post: Child Care and threat to sue

    The family was searching for a childcare facility and
    called this school. An appointment was set to tour the
    school. The couple is bi-racial. The school gave them a
    tour. The school made the couple fill out an application
    with confidential information concerning the child. The
    couple decided not to send the child to this daycare.

    The staff seemed to have a sour attitude about the
    family being of a mixed race. They also seemed to be really
    secretive about who owned and operated this school. The
    couple wanted to be sure who they were doing business with
    and to verify they did not have a history of any problems in
    the area of employee criminal background checks,
    certifications, accreditations, licenses, previous
    complaint, offenses, and compliance history according to the
    federal and state law prior to enrolling the child. The
    security of the school was lacking.

    The school invited the couple to the school for a tour
    and when they determined that they did not meet their racial
    requirements and that were asking too many questions they
    threatened to sue couple. The threat of legal action came
    after the couple requested that the school return
    confidential information about the child and they failed to
    comply. The couple filed a complaint and that's when they
    retaliated against the family in several ways. This day care
    wanted to shut the family up so to speak. They (day care)
    threatened legal action

    The threatened legal action accuses of several things
    that are baseless. Their attorney has threatened to make
    public information about the child that is private and
    should not be disclosed. Another claim is they (the family)
    owned a web site that is a free speech website that says the
    day care sucks. This is false. They did not own this
    website. They have threatened to sue anyway to shut the
    couple up and to stop them from filing complaints against
    this corporation.

    Their attorneys are engaging in SLAPP (Strategic
    Lawsuits Against Public Participation) -- Strategic Lawsuits
    Against Public Participation are civil complaints or
    counterclaims (against either an individual or an
    organization) in which the alleged injury was the result of
    petitioning or free speech activities protected by the First
    Amendment of the U.S. Constitution. SLAPPs are often brought
    by corporations, real estate developers, or government
    officials and entities against individuals who oppose them
    on public issues. Typically, SLAPPs are based on ordinary
    civil tort claims such as defamation, conspiracy, and
    interference with prospective economic advantage.

    The school is trying to turn the family into the ones
    that are the bad people by making false accusations and
    painting a picture that makes it look like criminal behavior
    on the part of the parents when their has been none.
    Obviously they intend to manipulate the truth and to harm
    the character of this family in retaliation for the
    complaints that have been filed against this day care They
    are trying to stop the right to engage in free speech. This
    school has serious issues and possibly criminal actions that
    should be investigated.

    It appears that this company has broken the laws, which
    protects citizens against racial discrimination and the
    right to free speech. We believe they are trying to make the
    family look like the bad people by attacking them and
    threatening them with legal action. This big corporation has
    more resources than an individual family does and is going
    out of their way to intimidate them so that they will shut
    up. In fact they are the ones that have brought about these
    issues by their actions and bad decisions.
