Post: Arizona Intoxilyzer 8000 machines in service

Arizona has seen the replacement of most of its Intoxilyzer 5000 alcohol breath testing machines with a newer model from CMI, the Intox 8000. CMI, according to prosceutors, refuses to release the source code used to program these machines. So far, the machines are being used in DUI trials in Arizona, and people are being convicted based on the reading from these machines. There looks to be brewing a battle over whether the defense is entitled to actually confront the witness against them (in this case the machine), or whether the Arizona courts will allow the admission of the results without a meaninful opportunity by the defense to explore how the machine arrived at the results. Some Arizona jurisdictions routinely use blood tests instead of relying on breath testing machines at all. These include DUI arrests made in Scottsdale, Chandler, Gilbert and Mesa.
