Post: California DUI question

Posted by 311 on 2/01/07

Just a question: I am representing a client in CA at a DUI
admin per se (DMV) hearing. The date on the BAC signed by
the nurse is four days after the date of his arrest. Can I
use this to my advantage in arguing that there is no way to
tell that the results were accurate and that this is not a
common practice/ not recognizable in a court of law? The
nurse's signature is next to the date when the report was
issued, does this matter at all? Any advice would be
    greatly appreciated!
