The circumstances as you portray them are grim. You may try to continue your 9th circuit appeal so that you may push the bar of time that he is held by the feds, over the time frame for the indefinite detention rule. Except in the most extreme cases, and that is contingent upon the district director-- and ultimately the 9th circuits-- criteria, he can not be held for longer than six months if his appeal is ongoing. Also, there is a custody review that takes place after the first 90 days... so good luck there. you can keep appealing to buy time, though your luck will run out at some point unless you can succeed in attacking the convictions.
