    We have hired an attorney for consulting..not sure how far we
    can afford to pay him. The filing fees in NY are $315.

    You have to decide whether you are filing for an injunction or
    judicial intervention to decide on the apprpriate way to serve
    the respondent. What type of petition are you filing?

    Our case has not yet been filed as the statute of limitations
    for this is 4 months. Some types, however are only 30 days.
    The time constraint is the most important detail. You can
    alway add to your case with ammendments after filing. Please
    feel free to email me. I would prefer knowing who I am
    responding to.

    Also this is not advise, just some knowledge I have obtained.
