    Post: Chapter 13 Payoff with Judgment Debt Civil Court

    A recent Chapter 13 case was paid off early due to the
    sale of the homestead. The debtors had two Judgment Debts
    in the Civil Court which the Title Company is holding in
    escrow. The Judgment debts were prior to the filing of
    the Chapter 13 and were listed on the debtor's schedules,
    but the creditors did not file a proof of claim. After
    the sale of the home the Case was discharged.

    Question: Since the creditors did not file a proof of
    claim are these debts deemed dischargeable. The sale was
    prior to the discharge. The cart before the horse
    question. Can an Application of Satisfaction to the Civil
    Court satisfy these claims through the discharge or does
    the Title Company pay those claims? Any case law out
    there??
