Post: ADVICE TO YOUNG LAWYERS ABOUT ACCOUNTING FOR RETAINER FEES

Dear Young Lawyer Friends, If you do work on a retainer basis, always document every move you make, every phone call, look at a law book, trip to the courthouse, conversation with your client or anyone else about the case. I have a spent a career handling cases on a contingent basis, so I never bothered to worry about documenting things. Now I am doing a lot of retainer fee work, and I have been called upon recently more than once to render and accounting to a client. In those cases I feel reasonably certain that I have more than earned the retainer fee, but being able to prove it to a client may not be so easy to do. Look out! Take it from an old hand! It's no fun writing down every move you make, but I promise you you will be glad you did when some client makes a demand upon you for an accounting. Best of luck! Sincerely, Hardy Parkerson, Atty.
