    Like it was stated earlier, I’m not sure of what your
    contract spells out for liability but here are some things to
    consider:
    1) You stated your concerns based on your knowledge of
    the structure as you observed it.
    2) You mentioned that there were concerns
    3) The buy most likely used an attorney for the closing
    4) The attorney should have noted your concerns and
    requested monies be put in escrow to cover any repairs
    5) I’d point the finger at the attorney who represented
    the buyer at closing; he/she shouldn’t be doing closings like
    a production line. The attorney’s job is to actually review
    the documents and look for legal liability issues, not to
    grab the paperwork some paralegal just pounded out, walk into
    the office with the buyer and sign off on everything and
    collect his fee. Now that the real estate market is so hot
    lawyers are just figuring the title companies and other
    interested parties did their homework and just sign off on
    the paperwork w/out adequately reviewing it. I’d contact the
    buyer’s attorney and ask him to explain how he allowed his
    buyer to close w/out addressing the roof concerns.
