I am in a same situation. I have been trying to cancel my contract with Toll Brothers. Who were you dealing with at Toll Brothers? They have been ignoring the letters and messages I sent to them. I have called every single day to get hold of the person who is in charge. He has never returned my call. I finally spoke with him today and he was very nesty and informed me that if I don't go to settlement, he will retain the deposit. Have you filed your arbitration?
