KB is not supposed to be using mandatory binding arbitration.
The Federal Trade Commission forbade them from using it because
of the abusive practices they were engaging in. KB has violated
the FTC consent decree numerous times over the past couple of
decades. You should file your complaint w/the FTC. Also this
sounds like predatory lending. Builders take the money then even
if they are obligated to return deposits under certain
circumstances, they don't. There are so many ways builders 'get
you' it's not funny. Please go to HADD.com and HOBB.org and get
their info. Definitely report the arbitration thing to the FTC,
sounds like another instance of violation of their consent
decree if you ask me.
