Post: California Rejects Reasonable Non-Compete Agreements

Posted by Brian Kindsvater on 2/16/09
The California Supreme Court recently rejected federal
interpretation of California law, in which Ninth Circuit
courts were upholding reasonable non-compete agreements.
Non-compete agreements are void in California, which was
affirmed by the Supreme Court in rejecting the federal
interpretation that a reasonable limitation would be valid.
The import nationwide is that per prior California
decisions, non-compete agreements validly entered elsewhere
will not be enforced by California courts if an employee
moves to California and desires to work for a competitor.
