Post: Transfer of Security Deposit liability

Posted by Ed Christopher on 2/07/06

    Facts:
Tenant A enters into a lease contract with landlord.
Landlord collect a security deposit from tenant A.
    Lease contract specifically prohibits subleasing.
Tenant A abandons apartment without landlord's knowledge.
Tenant B moves into apartment without landlord knowledge.
Tenant B pays tenant A the amount of security deposit.
Landlord later enters into lease agreement with tenant B,
but makes no mention of security deposit.
    Questions:
Is landlord liable to Tenant A under security deposit law?
Is landlord liable to tenant B under security deposit law?
Under what theory of law would the landlord become liable
    to tenant B?
