    Post: Window Replacement Contract

    We signed a contract with a remodeling company in March,
    2006 for the replacement of all windows and sliding doors
    in our house. At the time we were told it would take two
    weeks to get in the windows and doors and 4-5 day for
    installation. (Of course, we didn't insist that be put in
    the contract!) Now it is almost five months later and the
    job is not complete due to: damaged windows upon receiving,
    wrong size when received, and installer busy, etc. We wrote
    to the window supplier in July and complained about the
    Company we signed the contract with in March. They sent out
    an apologetic representative who promised the last two
    windows and one 16' sliding door would be here in about two
    weeks. We called this past Friday and they came in on
    Thursday before but we have still not been contacted by the
    Company to schedule the installer here and they have not
    returned our last Friday call. I am wanting to just tell
    them to cancel the contract, pay them for what has been
    done and find someone else to finish the job. However, I'm
    not sure the contract allows for that. In fact, it states
    we will have to pay 50% of total cost if cancelled. Do we
    have any alternatives?
