Dismissals with prejudice. A criminal case that was
dismissed with prejudice is being re-filed as a worse
charge. My question is< when the exact same material that
was charged and dismisssed with prejudice be re-used, by
changing the claim...in other words is the exact same
conduct that is now being re-used as evidence considered
as the original concepted charged and dismissed claim or
can the exact
same conduct be changed in concept and be re-defined and
re-filed as a new claim? Any Case Law?
