Post: IN SEARCH OF THE LAW , in north carolina

my guy , hereafter felon , was picked up in front his home for driving with out a license. Police requested to search the felons home he refused.Police then returned with a search warrant (which later i discovered to be a phony) Searched said home and nothing was said about it. Approxiately five months later they {the detectives } claimed the found a gun in the house but never arrested said felon. However this firearm was used in a shooting some nine months prior to this last arrest. And they charge my guy with the shooting using the gun as the evidence ! IS THERE A DUE PROCESS ON THE GUN IN QUESTION? WHAT IS A REASONABLE TIME FOR A LAW ENFORCEMENT AGENT TO HOLD EVIDENCE AND NOT CHARGE ANYONE? WHOM IS A MORE FAULT THE THE POLICE OFFICERS OR OUR FELLOW OFFICERS OF THE COURT WHO CURRENTLY ALLOW THIS CASE TO STAND ON THE DOCKET? I'M OPEN FOR ALL INPUT!
