This was actually my second offence. I had a dui 8 years ago at the age
of 21. The sentence was so stiff due to slight exaggeration by the
arresting officer. The issue of jurisdictional lines was brought up
during our little roadside visit. Obviously this officer did not like
this so he fibbed just a little. He stated he saw me enter the highway,
cross the center divider and drive into oncoming traffic. By the way,
there’s a 4 foot wall the entire stretch of that road dividing the north
from southbound traffic. This was argued in post trial motions but the
judge decided that the stop was legal under the fair police act due to
the fact that the officer was in hot pursuit, even though he didn’t see
me until 2.7 miles outside his line.
