Some cases yes, some no! Again, the key questions are:
How are you going to prove it?
How much $$$ do you have at your disposal to spend on this case?
How are you going to prove it?

It's your word against his and litigation is going to be
expensive, even if you find an attorney to handle your case.

IMHO: Find another doctor and consult with an attorney!
