However, usually when a person is sent back to jail during probation, probation is revoked and when resentencing takes place any time already spent on the revoked probation is meaningless. I saw a guy in court once get his 5 year probation revoked after 4 years and when he was resentenced he got one year jail and another 5 years probation. You can actually end up doing 10 years on a 5 year felony in some states if your probation is revoked. Talk to a local attorney if you can afford it. Good luck!
