Post: incorrect scoresheet for pleas and sentencing
Posted by Suz on 1/18/04
my son Aaron has been in jail since 11-6-03 for two "technical" VOP's(not getting NA/AA papers in on time & one curfew violation) while on probation (prob ended 7-6- 03...charges filed April 2003. No other VOP's while on probation. His attorney kept telling us Aaron would get at least one year & one day in prison or possibly up to 15 years!...for two technical VOP's - we could not understand why such a harsh sentence...that is until this past thursday we I discovered, when talking to his attorney, that there were 12 erroneous prior charges (belonging to another person) listed on his scoresheet - Aaron only had 4 priors of his own and no priors that were violent, and the only traffic tickets were for speeding. The incorrect priors were 3 DUI's, 3 batteries, aggravated assault w/weapon, 2 resisting arrests, disord. intoxication, obstruction of justice and petty theft. This made Aaron look like an habitual offender with little regard for the law. Now I hope his lawyer will step up and get this corrected with the court. This probably happens more than we realize - and it's a long weekend so we'll have to wait for any input to the court. Has this happened to anyone out there?
