Their processes are quite interesting. The actions are filed
in Minnesota. The Fair Debt Collection Practices Act requires
that consumer debt actions be brought where the consumer
resides. These guys give you the option to have a live hearing
in your district but only if you pay $150. Funny there is no
such requirement in FDCP.
It's obvious that this is a quasi-judicial group trying to help
creditors collect their money. They go out of thier way to hel
p the creditor.
I also believe that the arbitraton caluse inserted into the
terms fo the agreement ex-post facto violate various state
laws. And by the way they can never come up with evidence that
the clauses were part of the credit agreement but this doesn't
bother NAF>
