    Hi Terry.

    Well, that's the thing. If you mailed them the form in a proper manner you are not into an
    arbitration process. They will probably try to confuse you with internal rules and
    normatives but as long as you did mail certified the form to NAF and to the collection
    agency, you keep a copy of the letter and the receips from usps, I belive that there is no
    way for them to enforce anything in a court of law, even if they decide to go ahead with
    the arbitration without your consent, that award will be worthless and they will be
    risking a law suit from you if they try to enforce it on your local court, they know that.

    Don't talk to them over the phone keep in mind that they tape everything in a regular
    bases, keep all communications on writing.

    I think that what really did the trick in my case was my treath on the second letter of
    filing a suit even before they try to enforce the future award, after that one month later
    the NAF wrote me a letter to let me know that they can't take my case.... Like it was a
    bad thing


    In respond to Debbie.... Yes, I had luck. I'm not a lawyer and I can not give legal
    advice, as a matter of fact I just describing exactly step by step the way I did use to
    get rid of them. It works or at least it worked for me 3 years ago, the process tuck about
    three monts until I got the letter to inform me the they dessist arbitration. Can't say if
    it works now 100% sure after the last new bankrupt law but I guessing it still the same.
    I can't recomend you not to hire an attorney, if you feel safer that way you should go
    right ahead, it will be cheapper than going into arbitration that's for sure.
