Post: Do "Student Judicial boards" Violate Due process?
Posted by Ray Tylicki on 11/13/06
First off lets go with the assumption that education is a property right. (work with me here there is plenty of case law on this). In a public university allegations of student misconduct are heard by a J board composed of students and faculity that is appointed by the dean of students or the president of the college. The President is appointed by the board of trustees and in a state college that board is appointed by the governor.... So would not the fact that the Student Judicial board is indirectly appointed by the Governor violate the Seperation Of Powers Clause in the Conststution?
