Scenario: A probationer is arrested on a violation
allegation. The judge indicates "ROR" (release on own
recognizance) on warrant. However, the probationer was NOT
released by law enforcement contrary to the judge's clear
instructions but was actually incarcerated for 4 days before
being released. Is this a violation of due process?
