Post: Probation Violation
Posted by Faith on 2/18/09
My ex was sentenced to 18 mos probation for assaulting me. During the sentencing, the judge ordered him to abide by all laws and court orders. My ex and I have been divorced for 3 mos. The divorce judge ordered my ex to make monthly payments to me for student loans. My ex hasn't paid anything...so he is now 3 months behind. Could his non-payment be considered a violation of probation? Do Probation Officers usually address this type of issue with the person on probation...or is this considered a minor thing and something the PO would blow off? My attorney and I are in the process of discussing options...one of which are to take my ex to court on contempt charges. Is it a waste of time to inform the PO of my ex's non-payment and possibly facing contempt charges? Seems like contempt charges would be something the PO should be informed of.
