Post: Possible Hippa Violation

Posted by Tina on 12/07/06
On 11-24-06 I was wrongfully accused of "smoking Marjuana" while at work. I consented to a drug test and was sent home immediatly. I was put on administrative leave pending the results. When I did return to work, because I was in fact negative, I found out that one of the Nurses, although she was instructed not to, turned around and told 3 other people. When I approached my boss in regards to this matter he told me that I was not a patient and that I did not fall into those guidelines, but when I looked up the policy it in fact stated that they were not to talk about it. Not only that, but in order to take the test I had to be admitted into the system, and you can't even get into the results of my test unless you have administrative access. I have several questions in regards to this matter. First, were my HIPPA rights violated? Second, if so what are my recorses? Third, I was accompanied each time I went outside to smoke a cigarrette, why wasn't the other person made to be tested? Forth, my boss is not trying to get me to take a different shift to give "me a break". I'm affraid they are trying to wean me out of a job period. Please!!!! I really need some answers. I have been litterally consummed with this matter since it begain. I need some advise.
