Post: Can employer sue ex-employee for negligence?

Posted by China-Clipper on 4/24/07
I have a potential client who fired an employee after he drove his company dumptruck into another vehicle, was ticketed, the employer's insurance paid the claim and dropped the employer. Now the employer can't find reasonable insurance and has to pay double the amount. The ex-employee (driver) had a CDL license and held himself out as a competent certified commercial driver. Can the employer now sue for negligence and win a judgment for the cost of additional insurance?
