"I have filed a complaint with the EEOC - they felt it
serious enough to investigate the matter." ALL complaints
    are investigated by the EEOC.

You will if either the EEOC or the DOL issue a "right to
sue" letter which means the legal ball will then be in your
court. You'll have 90 days to file a civil suit against the
employer. You may want to "interview" some attorneys now to
discuss the merits of your claims and have someone lined up
if you decide to file suit against the employer after the
EEOC and the DOL issue their findings.
