If you're in an at-will state, and you aren't an employee with a contract which governs how leave is taken, yes. If you have a chronic illness, have been at your employer for at least one year, and if the employer is required to offer FMLA, you may want to consider filing for intermittent FMLA. It may help protect your position if you haven't already lost it. If you have already lost it, you can't apply for this retroactively.
