    Post: contract law - breach

    Posted by jenni on 5/21/08

    question - (lurker poster)
employer tried to move my position (I work in health care)

they had just moved me 9months earlier and at that time
had promised this would be permanent (5th place in 5years)

now announcing they were closing current building.

gave me three options - I refused all based, they refused
    what I proposed.

in my contract says "mutually agreeable location,
    agreement not unreasonalby withheld"

I gave them 30d notice as per the contract, they responded
on the 30th days saying that I was breaching!

then they withheld paying out paid leave I took in the
last pay period contigent on signing a settlement.

If I want to work anywhere else, then it is important who
    is the first breach.

does promissory estoppel apply? wage withholding?

    thanks in advance
