    Unless he's in a union, then, there's probably nothing
    illegal about it.

    And, what makes you think it would not be legal? A private
    employer not using union labor can pretty much fire/hire
    whoever they want as long as it does not base its business
    decision on race, creed, color, gender, national origin etc.
