Post: Targeted for Termination

Posted by Jerry, jjaravata@sagent.com, on 10/23/01
I am working as a Sales Agent in an At-will employee. My Manager is giving me the choice of resigning or she will terminate me on bases of misconduct. Are there any legal grounds to file a claim or lawsuit, if my Manager is using specific misconducts in company policies to terminate me, while it is clearly evident that those same specific misconducts in company policies are not enforced on the majority of my peers and co-workers? Ex: reprimanded for being late when, when my entire group of my peers have not arrived for work yet. Being the only Asian male in Account Managment in my entire Branch, I have had a continued concern that I have been singled out and placed under a higher level of scrutiny in order to justify my termination.
