    Post: conflict of interest

Posted by Debra Heumphreus on 1/01/03

My sister in law hired an attorney to write a will for my
father in law, she paid the attorney. The attorney never met
with or spoke to my father in law. She had the will signed
and witnessed at the emergency room-father in law a big
drinker and had fallen once again. Now a few days later
this same attorney represents her in my grandmothers estate
(lost will) the new will my father in law signed drastically
changes my husbands inheritence. The sister in law had
threatened to make us sorry that we asked for a neutral
administrator-no she was not named executor in the lost
will-named executor-declined. We have just found out about
the new will and my father in law doesnt remember anything
and no he does not have the will in his possession. Is this
not a conflict of interest for my sister in laws attorney?
Should we bring it to the attention of the Judge,. Our
    attorney doesnt respond when asked.
