Post: Request Advice on Attorney Management
Posted by Bob WIlliams on 1/18/04
I am in the middle of a divorce and have been for 18
months. I originally retained my attorney with $2000 up
front and agreement to pay a monthly payment when the $2000
was expended. AT that time, he estimated that the divorce
would cost between $2000 and $2500.
To Date, he has failed to advise me properly on a key issue
that would have expedited my case, he has failed to
communicate with my wifes attorney regarding a property
agreement and he failed to notify me that a Request for
Documets had been filed against me until after the due
date. (I don't know if this will result in a contempt
charge). I also live in NM and the Divorce case is in
Virginia. To date, the total attorney's fees have risen
to $5,534. He has demanded payment in full plus and
additional $1000 to continue my case--otherwise he will
file a Motion for Withdrawl and contempt hearing.
My questions: Is his demand ethical and reasonable in the
courts eyes? If we can't come to agreement on a payment
plan, would it be benefical for me to fire him for cause,
prior to his Motion for Withdrawl?
