I was arrested in June of 2002 and charged with "Terroristic Threatening" after one wal-mart staff member made a false statement to a police officer. Eventhough there were thirty or more people present when the incident took place. This included several of the stores managers and someone whom I believe was security. The police officer swore out a warrant for my arrest and I was arrested at my home several hours after leaving the store. The police officer later withdrew his complaint. He was subpeonaed several times to come to court and to supply witnesses for the prosecution. The officer wrote on one of the subpeonaes that my case was to be dismissed, that wal- mart did not want to go forward and would not help the police officer. Neither the police officer or anyone from wal-mart ever came to court against me during the five months of my criminal proceedings. I requested a jury trial. I paid an attorney in advance to represent me at trial. I had refused all of the prosecutors offers. Which was "Dismissal/With Deferred Prosecution" and "Dismissal/With Probable Cause." I was prepped for trial. A month before my trial date I was told to meet my attorney at the judicial building by his receptionist. My boyfriend and I met with my attorney outside of the judicial building. I distinctly told him that I would accept nothing from the prosecution but "Outright Dismissal" or that I wanted to proceed with my trial date which he had already been paid for. The three of us enter the courthouse and my case gets "Dismissed/Without Prejudice." I had already gone before two different judges. The third judge who presided over the disposition of my case was the same judge who had signed my arrest warrant for the police officer. Later, I come across a document called a "Guilty Plea Disposition Recommendation." I never heard of it. This document is signed only by the prosecutor eventhough there are spaces for the defendant and the defendants attorney. This unsigned document could not have been over-looked by my attorney or the judge. I was never told of a guilty plea by the judge or anyone else. I was not told that I was waiving my right to a jury trial. I assumed that my case was outright dismissed. I have never been able to find an attorney to help me because of the "Without/Prejudice." My statutes of limitations were about to run out and I filed a civil complaint in Federal Court under "Informa Pauperis." This was in October of 2003. I was granted to proceed with my case as Pro Se. I was told by the court clerk to do nothing but wait until the judge orders the U.S. Marshal to serve the Summons. I need an attorney and can't acquire one because of the conspiracy in my criminal proceedings. I would like to have the decision of my criminal case reversed and I would also like to have my civil complaint amended before the judge orders the Summons to be served. Can anyone help? Is there anything that I can do?!? Thanks, Angela
