My estranged husband has been having an affair for going on 2 years now. He left home almost a year ago and I filed for separation. We have two young children. We live in VA.I have primary physical custody and he has supervised visitation as decided by the court. He was ordered to pay child and spousal support as well as our mortgage payment. The child and spousal support is deducted from his checks, but he has not paid the first mortgage payment. We are scheduled to have a final divorce hearing in a month and I just found out that his mistress is pregnant with what is presumed to be his child. We have been in marriage counseling off and on for 7-8 months and now that I know everything that I have suspected all along is true, he now is considering whether he wants to come home or be with the mistress. Obviously, I have many questions as this is a very complex case, but my main questions follow: 1. What do I risk if I agree to work on things when this goes to court? 2. If we remain separated, will child support paid to my children change due to having a 3rd child with her? 3. If I ask to not declare the divorce final at this time so that we can "work on things", what do I risk losing in the future if we do finalize the divorce? Will the support be reduced due to the case with her and the new baby? 4. What are my husband's financial responsibilities to the mistress and the illegitimate child? 5. Does he have to sign the birth certificate? 6. How can he have paternity determined? 7. Can he give up parental rights? Does that affect the amount of support? 8. What is he expected to pay for as far as the unborn child if he does not stay with her? 9. Can the mortgage payment be deducted from his check? 10.. Can he go to jail for contempt of court by not paying the mortgage? Any help is greatly appreciated...this is a MESS!
