    I am not sure how your situation would work, because of the
    marriage, but I do know about the custody issue. I was in that
    situation not too long ago. I have two children, and the
    father signed their birth certs, but we were never married.
    After I had my second child, I wanted to move out of state, so
    I contacted an attorney in the state I was moving from, and an
    attorney in the state I was moving too, to make sure I could
    legally make the move without the father's permission. They
    BOTH told me yes, because if there was no marriage, the mother
    AUTOMATICALLY has custody, and the father would have to take
    it to court to get custody or visitation. I would guess it
    would depend on your state and their laws
