    Post: Legal custody

    Posted by Frances on 6/12/07

I have an 11 year old son whos father and I have lived
together on and off for 12 years. The fathers name is not
on the birth certificate but he is the father. This
relationship has come to an end. I want to move to another
state to start over. I am a seamstress and my job is not
very stable. I have no other education for a better job.
My brother has offered for me to come to Tenn. (I live in
SC)and help me go to school to get a better job so I can
better support myself and my son. I have talked to child
support already. A friend of mine said her brothers lawyer
said if the parents of a child are not married before the
child is born he has no legal rights only biological
rights. Meaning he can pay child support and get
visitation, but no legal custody rights, which means the
mother has all the rights to say what her and her child
can do. The brothers lawyer also said for him to legal
rights he has to adopt his own child (if the mother agrees
    to that). Is this true?
