Is there a court order that you pay support? Or, do you pay
voluntarily?
If there is a court order that you pay child support that
means that you have legally established your paternal rights
to the child. You may petition the court to have the child's
name changed to your last name.
If there is no court order that you pay child support, you
must first establish paternity if you want to ask the court to
change the child's name. Until you legally establish
paternity, you have no say so whatsoever ih regards to this
child's life. The fact that your name is on the birth
certificate does not necessarily legally establish paternity
UNLESS you were married to biomom at the time of the child's
birth and no other man has claimed to be daddy.
