Petition the court. You will have to notify all parties who
are required to get notice under your state's laws,
including biomom if she's alive and can be found. The
burden of proof is on you to prove that it is in the best
interests of the children to appoint you their legal
guardian. You can expect biodad to contest the
guardianship.
The fact that biodad does not do anything for them does not
make him an unfit parent. There has to be more than an
allegation by you that he doesn't do anything for his
children. Calling your mother bad names and wishing she
were dead is not grounds for suspending his parental rights
and appointing anyone a guardian.
You don't just go suspend someone's parental rights and
appoint a legal guardian based on the scant info you've
posted.
