Post: Child Custody and Relocation

    Hey! My question is regarding relocation of children
    after divorce.

    I have found that lots of details just don't matter in
    court, so the facts are:
    * 6 years after the divorce I still live in the same
    town as my ex.
    * We have joint custody (OKlahoma) but I have the
    primary residence
    * I remarried 2 years ago and my military husband lives
    3 hours away - we get together on weekends
    * Years of his repeated motions to modify custody have
    kept me in court until I am out of funds.
    * My military husband has orders to Florida and we can
    no longer support two households - so I need to move with
    him. Seriously, I can't pay the bills.
    * ALL the judges in my home town have recuised (sp)
    themselves because we all used to hang out (personal
    friends)
    * In all of his attempts to gain sole custody, he has
    only been awarded an additional Wednesday night. Every
    time the court finds that we are both perfectly good
    parents.

    QUESTION: Our state has a presumptive custodial parents
    right to move when the reason is compelling - which I
    think mine are compelling, but will the fact that we have
    JOINT custody with nearly equal time negate that since
    there is no way my ex will have that much time if I am
    allowed to move with the children?
