My husband is being brought to court by his ex girlfriend
for child and spousal support. The children are not his.
He has never claimed to be a parent although at one time
he did support them.
In British Columbia, in a common law relationship a party
has one year to file from the time of the separation. It
has been at least 3 years since they separated and she
only filed and had us served on Christmas Eve 2007. She
states in her application that they have been separated
for more than a year but she says she was granted access
to his bank account until September 2007. This is not true.
(We have discovered she has been forging cheques, taxes
and other documents in his name). We are also filing for a
restraining order due to death threats, stalking etc.
Anyways, we had ANOTHER court date 2 days ago. (4 so far
and it has never proceeded.) His ex decided not to show by
faking illness and she also decided to get a lawyer. The
lawyer decided to fish ans my husband told her his ex
didn't file within the one year. The lawyer agreed but
said there was other avenues that can be taken to make him
pay. Does anyone know what those could be??? We can't
afford a lawyer right now and unfortunately don't qualify
for leagl aide. I thought I would try here first.
