i'm not sure if that would considered kidnapping since there
is no legal custody agreement. you should go to the court
house immediately and file for custody then she would have to
come back for the hearing. i'm sure that there is more you can
do, but i'm not sure what. i did find 2 web sites for NY law

you can also go to www.lawguru.com you ask a question and
lawyers will look over them to tell you what can be done if
anything. wish i had more advice for you. hope this helped a
