    I have a daughter that resided in SD at the time of her
    marriage and when she wanted a divorce she decided to move
    out of state. Somehow everyone told her that if she moved
    she wouldn't be able to take her son, so gullible as she
    was she agreed to joint custody with physical custody to
    the father since he would remain in the state which would
    allow both sets of grandparents and other family members
    to stay close to him. So his mother has pretty much taken
    over responsibilities for care of this child. It states
    in the decree that custody/visitation will state the same
    until he turns age 5 and then I believe they are to
    revisit the terms again. Since last fall the father has
    also moved out of state with his son. My daughter would
    like to get physical custody, but lawyers say that because
    she willing let father have custody that she will have a
    difficult time gaining it back. Also the SD Lawyer says
    that it will be costly and that a social worker will have
    to travel from SD to her state for inhome visits and that
    will also be expensive.
