Post: recently abandoned by fiance

i am 34 1/2 weeks pregnant with my ex's son. we have been
having problems recently, and he said that he needed a few
days alone just to clear his head, and asked me to leave.
i went to my parents house and with in 3 days he changed
the locks on our apt while we are both on the lease, and
never told the landlord, and is refusing to give me a key.
my question though is, how soon can i file for custody and
support? does the baby have to be born when i file?
