Post: How do I officially fire lawyer who won't stop workg for me
Posted by ssly3333 on 9/16/09
I’m a 49-year-old man who is disabled and who used up all
my saving to pay lawyer fees while battling my ex-wife in
court so that I can continue having full custody of my
three children. I have no been able to work fot the last
three years after my car accident and still trying to get
disability.
Anyways, I fired my divorce lawyer two months ago via
email, telling her I no longer wanted her services and for
her to officially withdraw from being my legal
representation; however, now it’s two month later and she
(my lawyer) still refuses to stop “working for me,” and she
has racked up a lot of work and billed me about $2,500
since I fired her two months ago.
My question (s) is: What is the process to officially show
the court that my lawyer is no longer my lawyer to force my
lawyer to stop, so that I can then request pro bono
services? Whom do I need to inform and especially
what “wording,” “terminology,” or “lawyer lingo” do I
definitely need to put in the letter to my lawyer to make
it official? Do I need to fill out a form at the courthouse?
Sadly, my computer crashed and I lost my email telling her
she's fired AND her email stating she's backing off from
being fired—so now I have no evidence to prove I fired her
in the first play and will probably just have to borrow
money to pay her that extra $2,500.
Thanks.
