He doesn't have any rights until he establishes those rights
under your state's laws.
Generally, some of the ways a biodad can get paternal rights
is to sign the child's birth certificate (that's usually
considered an acknowledgment of paternity). Doesn't look
like that's going to happen in your case.
Or, he can petition the court & get a court order declaring
him biodad. He can then ask for visitation. Of course,
with paternal rights and/or visitaiton comes his legal
obligation to pay child support. Doesn't look like that's
going to happen, either.
You can still file for child support & the State will help
you if that's what you want to do -- but once you file, you
have to name the biodad & paternity will be established. If
he has no job, it's going to be a miracle if your baby ever
gets any child support.
Is it wrong...: That's a moral question -- not a legal one.
