The answers depend on whether or not the biodad has established his paternal rights under the laws of your state (i.e. were you married to biodad when the child was conceived/born; did biodad sign the birth certificate; is there a court order establishing paternity, etc.) If biodad has not established his paternal rights, he's nothing more than an alleged biodad and, therefore, he has no legal rights or obligations regarding your child.
