Post: Does Abuse Nulify a prenutptual agreement?

    Posted by NCSmith on 2/18/10

I have been married to my husband for 4 years. Before we
were married we put together a prenuptual agreement that
would make it nearly impossible to get a divorce.
Including several months of madatory counceling and 6
months of required seperation before filing. It would
also benefit completely the spouse who does not file for
divorce and cut the one that does completely out of
receiving any kind of monetary settlement. The issue is
that my husband repeatedly beats me and threatens to kill
me. He also tells me daily he hates me and that he wants
me to leave and he emotionaly and physically abuses my son
who he has since adopted. He has refused to ever let me
get any kind of job except to work for him and I have been
running his company for the past four years without any
type of actual pay. Not tot mention I have raised his
three children for the past 6 years. If I actually left
him I would have absolutely nothing and no where to go
seeing as he has cut me off from any friends or family
over the years. I know with my experience and licensing I
could make a living in my industry, but I also know in
order to get anywhere I would need at the very least a
monetary amount of money and property to start over not to
mention I would want out and away fast which our prenup
does not allow. Is there anyway that the abuse would
serve as a way to void this prenup?
