    Post: my ex has taken both my baies from me

    Hello. Well where to begin...
    In January 2010 my ex ran off with my daughter while i was
    in the hospital in the ICU with my newborn son who had
    RSV. It is now May 12 2010. Two days ago he took my son.
    We went to child supprt hearing and he reported me to the
    police for having traffic warrants. So I got arrested. He
    contacted our cps worker and went and took my 5 month son
    out of daycare. cps said they had no choice since i was
    not present.
    I was in a very abusive relationship with him. He
    constantly hit on me and kicked me when i was pregnant
    with both babies. I never left because I feared for my
    life and my families life. I tried to leave but he always
    said he would kill my mom and sister if I did not return.
    Now I am in a Salvation Army transitional living program.
    Enrolled in college seeking a criminal justice degree.
    Trying to become self sufficient after years of being in a
    relationship where I actually depended on him.

    So here are some facts: I signed acknowledgement of
    paternity with him for both babies. But I honestly felt
    like he would harm me if I didn't. He was unfaithful and
    harsh so I had another man in my life that I turned to for
    comfort. I felt he would hurt or kill me if he knew I was
    also unfaithful toward him. Q
    QUESTION 1: Will I be in trouble with the law since it is
    under risk of perjury that I signed it.

    FACT: He has not had dna tests for both these babies and
    is only a presumed (petutative) father. He has not seeked
    his rights as a legal father or even proven through dna
    test that he is their father.
    QUESTION: Can I take the police with childs birth
    certificate and ask for my child back? He is not on my
    sons birth certificate so I am assuming I can get my son
    back. I have been advised that even if he is on my
    daughters birth certificate that he is still a petutative
    father since there is not paternity established through
    dna.
    Is this correct?
    Any information would be appreciated that can help me
    better understand the law and our rights. We have a cps
    case and he has a history of using drugs and neglecting my
    daughter under the influence of cocaine. cps is not
    helping. They seem to prefer the father since he lives
    with his mother in a house and I live in the program I am
    at. Cps also showed him where I live knowing that he has
    threatened my life.
    This is urgent. Please respond to me as soon as u can at
    your earliest convenience.
